These Terms & Conditions (the “Terms”) govern your access to and use of the Kinesin Patient Portal (the “Portal”), an online service that lets patients of participating practices manage their care — including registration, appointments, secure messages, prescriptions, medical records and billing. By creating an account or using the Portal you agree to these Terms.

1. About us

The Portal is operated by Kinesin Health (“Kinesin”, “we”, “us”). If you have any questions about these Terms, contact us using the details in section 13.

2. Eligibility and registration

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You agree to provide accurate, current and complete information during registration and to keep it up to date.

Registration is completed in steps: you provide your email and set a password, verify your email address with a one-time code, and provide your personal and contact details. After you submit your registration your account is created in a pending state and must be approved before you can access patient features. We may refuse, suspend or revoke registration at our discretion.

3. Your account and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. If you sign in using a third-party provider (such as Microsoft or Google), you are also bound by that provider’s terms. Notify us immediately if you suspect any unauthorised use of your account.

4. Acceptable use

When using the Portal you agree not to:

use the Portal for any unlawful, fraudulent or harmful purpose;

access or attempt to access another person’s account or data without authorisation;

upload malicious code or interfere with the security or operation of the Portal;

copy, scrape or reverse-engineer any part of the Portal except as permitted by law.

5. Medical disclaimer

The Portal is a tool to help you manage administrative aspects of your care. It does not provide medical advice, diagnosis or treatment, and it is not a substitute for professional clinical judgement.

The Portal is not intended for emergencies. If you are experiencing a medical emergency, call 112 or 999, or attend your nearest emergency department immediately. Do not use secure messages to report urgent or emergency symptoms.

6. Services facilitated through the Portal

The Portal may allow you to request or manage appointments, exchange secure messages with your practice, view prescriptions and medical records, and view or pay for services. These features are provided by, and remain the responsibility of, your practice and its clinicians. Availability of specific features may vary by practice.

7. Data protection

We process your personal data — including health information — in accordance with our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use and protect your data.

8. Intellectual property

The Portal, including its software, design, text and graphics, is owned by or licensed to Kinesin and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Portal for your own personal, non-commercial use of your care.

9. Availability, changes and termination

We aim to keep the Portal available but do not guarantee uninterrupted access, and we may modify, suspend or discontinue features at any time. We may suspend or terminate your account if you breach these Terms or where required for security, legal or clinical reasons. You may stop using the Portal at any time.

10. Limitation of liability

To the fullest extent permitted by law, Kinesin is not liable for indirect or consequential loss, or for loss arising from your reliance on the Portal for clinical decisions. Nothing in these Terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence.

11. Governing law

These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction over any dispute arising from them.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Portal after changes take effect constitutes acceptance of the updated Terms.

Clinician app privacy

This page explains how the Kinesin Clinician mobile app handles information. It supplements our privacy policy, which continues to apply in full — including the basis on which we process personal data, how long we keep it, when we act as a data controller and when as a processor for your practice, where data is held, and your rights. This page adds only what is specific to the app.

The app is used by clinicians and practice staff. It is not a patient-facing app and is not available to patients; patients should read our main privacy policy. Access requires an account issued by a practice that uses Kinesin.

If you have a question about anything here, contact our Data Protection Officer using the details in our privacy policy.

Verifying a device

Before the app can be used, the install must be verified. We ask for the work email address and mobile number already held for that clinician, and send a one-time code by SMS to that number. This confirms that the person setting up the app is the clinician whose account it is.

If verification succeeds, the app stores on the device a randomly generated device identifier and a flag recording that the device is verified. The identifier is generated on the device, is specific to the install, and contains nothing about the clinician or the handset.

Information the app handles

About the clinician using it

Work email address and mobile number, for verification and sign-in.

Sign-in credentials and session tokens, stored on the device as described under Security on the device below.

A device identifier and the push notification token issued by Apple, so the device can receive notifications.

Diagnostic and crash information, used to find and fix faults.

About patients, handled on behalf of the practice

Appointment, patient and clinical record information drawn from the practice's Kinesin system and displayed in the app.

Dictation audio recorded by the clinician to produce consultation notes and letters.

Photographs, scans and documents captured or attached by the clinician for the patient record.

Kinesin acts as a processor for this patient information, on the instructions of the practice, which remains the controller. It is the same data the practice already holds in Kinesin — the app is another way of reaching it, not a new collection of it.

Recording and photography

Dictation audio is recorded only while the clinician is actively recording, and only to be turned into notes, letters or documents in the patient record. The app does not listen in the background and does not record at any other time.

Photographs and scans are captured only when the clinician chooses to attach one. Images taken on a phone can contain location information; the app does not use, read or store that location data.

A dictated note, letter or attached document becomes part of the patient record held by the practice, in the same way as anything else the clinician records during care.

Information stored on the device

When there is no usable connection, dictation audio and documents waiting to be uploaded are held on the device in the app’s private storage, together with a small record of what is waiting and why. This is what allows a clinician to work in a building with no signal and have the work sync later.

Each item is deleted from the device as soon as it has been successfully uploaded. Nothing is deleted on a timer: an item that cannot be uploaded is kept and retried indefinitely, because until it syncs it is the only copy of part of a patient's record.

Security on the device

Sign-in credentials and session tokens are held in the iOS Keychain (or the Android equivalent), protected by Face ID, Touch ID or the device passcode. The app asks the operating system to confirm the clinician before releasing them. Biometric data itself never leaves the device, is never seen by the app, and is never transmitted to or stored by Kinesin — the app only ever receives a yes or no from the operating system.

On Android, the operating system is instructed to block screenshots inside the app. On iOS, where this is not possible, the app detects that a screenshot has been taken and can warn the user.

Signing out clears the stored credentials and tokens from the device.

Notifications

If notifications are allowed, Apple or Google issues a token identifying that installation, which we store so notifications can be delivered. Notifications are used to alert clinicians to activity relating to their work. Notification permission can be withdrawn at any time in the device settings.

Information we do not collect

The app contains no tracking, advertising or analytics SDKs, and no information is shared with data brokers or advertising networks.

The app does not use Apple Health / HealthKit or Google Fit. Clinical information comes from the practice's Kinesin system only.

The app does not collect device location.

Where the information goes

Information handled by the app is sent to the Kinesin practice system used by that clinician's practice, over an encrypted connection, and to no other third party.

This Privacy Policy explains how Kinesin Health (“Kinesin”, “we”, “us”) collects, uses and protects your personal data when you use the Kinesin Patient Portal (the “Portal”). We are committed to protecting your privacy and handling your data — including health data — in line with the EU General Data Protection Regulation (GDPR) and the Irish Data Protection Act 2018.

Using the Kinesin Clinician app? A supplement to this policy covers what is specific to the mobile app.

1. Who is responsible for your data

Kinesin acts as a data controller (and, for some processing carried out on behalf of your practice, as a data processor). Where your practice determines how your clinical data is used, the practice is the controller for that data. If you have questions, contact our Data Protection Officer using the details in section 11.

2. Personal data we collect

Depending on how you use the Portal, we may collect:

Account data: your email address and password (stored in hashed form).

Identity data: first and last name, sex, date of birth and PPS number.

Contact data: phone number and address (address lines, city, county and Eircode).

Verification data: the one-time codes used to verify your email address.

Sign-in data: identifiers from a third-party provider if you sign in with Microsoft or Google.

Care data: information related to appointments, secure messages, prescriptions, medical records and billing that you access through the Portal.

Technical data: device, browser and log information, and limited analytics needed to run and secure the service.

3. Health and other special-category data

Some of the data we process (such as medical records, prescriptions and information about your care) is special-category health data. We only process it where we have a lawful basis to do so, such as your explicit consent, the provision of health care, or another basis permitted under Article 9 GDPR.

4. How and why we use your data

We use your personal data to:

create and manage your account, including email verification and account approval;

provide the Portal’s features — appointments, messages, prescriptions, records and billing;

keep the Portal secure, prevent fraud and troubleshoot problems;

communicate with you about your account and the service; and

comply with our legal and regulatory obligations.

Our lawful bases include: performance of a contract with you; your consent (which you can withdraw at any time); compliance with a legal obligation; the provision of health care; protection of vital interests; and our legitimate interests in operating and securing the Portal.

5. Account approval

New accounts are reviewed and approved before they can access patient features. This helps us confirm that access is granted to the right person and protect the confidentiality of health data.

6. Who we share your data with

We do not sell your personal data. We may share it with:

your practice and its clinicians, so they can provide your care;

service providers (processors) who host and support the Portal, under contracts that protect your data; and

public authorities or regulators where required by law.

7. International transfers

We aim to store and process your data within the European Economic Area (EEA). Where data is transferred outside the EEA, we put appropriate safeguards in place, such as European Commission standard contractual clauses.

8. How long we keep your data

We keep your personal data only for as long as necessary for the purposes described in this Policy, including to meet legal, regulatory and clinical record-keeping obligations, after which it is securely deleted or anonymised.

9. How we protect your data

We use technical and organisational measures — including encryption in transit, access controls, email verification and two-factor authentication — to protect your data against unauthorised access, loss or misuse.

10. Your rights

Subject to conditions in data-protection law, you have the right to:

access the personal data we hold about you;

have inaccurate data corrected;

have your data erased in certain circumstances;

restrict or object to certain processing;

data portability; and

withdraw consent at any time, without affecting processing carried out before withdrawal.

To exercise these rights, contact us using the details below. You also have the right to lodge a complaint with the Irish Data Protection Commission at www.dataprotection.ie.

11. Cookies

The Portal uses cookies and similar technologies that are necessary to sign you in, keep your session secure and remember your preferences. Where required, we ask for your consent to non-essential cookies.

12. Children

The Portal is intended for adults. We do not knowingly create accounts for children without appropriate authority and safeguards.

13. Changes to this Policy

We may update this Policy from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you.

Kinesin is a type of protein known as the workhorse of the cell, as it drives cell organisation and power. We see Kinesin practice management software as the workhorse of our daily practice. It facilitates every activity and helps us strive towards excellent patient care.

Our Kinesin journey began when doctors Darren and John noticed how dated and unintuitive their practice management software was, and decided to build a better system.

The available systems were difficult to navigate, required multiple clicks to get simple jobs done and consumed precious time that should have been spent caring for patients. Other practice team members found time was lost on mindless administration and the old systems lacked tools to facilitate efficient practice management. There was also no sensible use of data to support patient care.

They found that their colleagues faced the same old systems and lack of choice. They searched for good alternatives and found none. The only systems available used old technology that was years behind the innovation in other sectors.

They decided to build a better practice management system for all healthcare disciplines. Kinesin - designed and developed by healthcare professionals for healthcare professionals.
